All patent applicants have a "duty to disclose" any prior art they know of that is applicable. Some applicants abuse this to try to bury Examiners in paperwork (I've had disclosures that amounted to several hundred patents with many not even being tangentially related). If they know about your invention and don't disclose it, Patent Examiners can't really go after them for that but it *may* cost them extra time in the application prosecution process as the examiner presents the prior art in a rejection and they have to respond. If they disclosed the art already, the Examiner absolutely can still use it in a rejection, but they are likely to be more careful in their analysis of the applicability of the art to the claims that the applicant filed and not try to bash together a loose rejection off of art they found (this all works in the applicants favor to speed up prosecution of their claims which is typically an 18 month to 36 month process).

Despite the pressures on Patent Examiners, something tells me if I reviewed the prosecution history I'd be disappointed that they failed to use a 102 rejection (lack of novelty) for independent claim 20 using r/homegym as the prior art and a 103 rejection using anything like the Ares / Athena trolley and the same prior art I'd use for the 102 I described above. Adding a pop-pin (they call it a "trigger lock" in the other independent claims) should be a matter of obviousness under 103 because the Athena / Ares trolley is already a known method by which one adjusts a trolley on an upright with apertures within the same technology area with a simple KSR reasoning. Right now, most products I've seen on the market are safe from litigation (I think, because I was never a patent attorney, I've never been on the litigation side of the house) but not safe from the "threat" of expensive litigation to prove that they don't violate the patent. The only ones truly at risk are companies that try to sell a vendetta + kaizen + jammer arm combo and they also sell power racks, uprights or squat stands.

I do see similarities between the two, PRX is dead to me. But, I own the very limited Rep Iso arms and the (In my opinion Superior to Rep) - Griffin 2.0 Jammers. I wanted the Vendettas but was always missing the ordering window. Looks to me like PRX needs to go back and better refine those a bit. Especially for that crazy price. Your Gympin version w/Vendettas clearly win the design aspect... I've got some good Jammer-handle ideas I'd like to share for a mere proto type pair in return.

Yes, people acting like patents are easy don’t know what they’re talking about. It can take months and sometimes years, and the little guys will more often lose out to bigger more established companies who have the resources and time to dedicate toward the process. Early release or video demos, just make it easier for the bigger companies to rip you off. I feel for you.

I wholly disagree on this for small businesses in the industry with giants who can squash smaller competition. Patents over/before partnerships. Even with limited knowledge regarding patent defense/litigation

I hope you and Vendetta are taken care of. I will always support the original creators. I stick with Sorinex for all my Base Camp needs. I have the vendetta trolley attachments to go with them.

People borrow ideas and make money from them. Just like you borrowed my spring-loaded kickstand idea for a belt squat system and incorporated it into the Mammoth Belt Squat with Fringesport. Granted, you did tag me on insta in your initial prototype post, but no props or "collab" requests when it came to an actual product. Of course, I didn't patent that idea. And people (including you) used it. Should I get royalties?

If you can prove that you had your product on the market before their patent hand-in date, you can attack them.

I appreciate the update! I haven’t been able to follow along as closely as I would have liked, but I did see the clip of PRx’s response on Instagram and oh boy. Needless to say, I’m looking forward to your next update and hope that PRx changes their tune.

I think it’s interesting that you keep on saying that the patent process was just too expensive but are also apparently asserting that your designs were so valuable that PRX should have given you credit/collaboration/royalties. Which is it? If your IP was valuable you could have fund raised or financed the costs needed to secure the patents. And if your IP wasn’t valuable enough to justify all that then (adopting your view that PRX took the idea) what did they really rob you of in the end? I genuinely don’t understand what you think you are entitled to?

Integrity is doing what is right when no one is looking. In this case many people were looking and they STILL got it wrong. You only get one shot to make things right I suspect the community will ensure their bottom line takes a hit. And to add this, I’m sure there are lawyers in the community that would work with you at a discount going forward with your ideas so hopefully this situation doesn’t happen again. That being said I’m not a lawyer

Respect to you for the follow-up; I was not familiar with your content before seeing your first video on this, but you've earned a subscriber for what that's worth. I certainly like the collaboration approach more and I understand being constrained by money, so I can't blame you with not being able to complete the patent process. It's very unfortunate that their response was just generic corporate speak, even if it is completely true, it comes off as very robotic and certainly not what the community wanted to see.

Seems like an opportunity to redesign jammer arms that are more useful across the board. Full motion, a lot of vertical and horizontal locking points, an option to route cables from a pulley set-up through them, and being able to quickly attach/detach the trolley. I'd be fine with keeping the trolleys on fulltime but at least easily remove the arms so they're not in the way when not in use (although the Legend Fitness design of swiveling the arms 180 degrees is pretty cool).

Respect this. I was among one of the people promoting Gavin's work. I have his GLS jammer arms from Primal Strength in the UK and I use them almost every session. Love them!

Besides the commercial aspect I don't see how this is different than the havak triad situation. I don't support commercial rip offs, but this specific negative reaction just didn't sit right with me.

I skimmed through their patent and they sited/referenced you and a host of other people and companies. Everyone from you and Gavin to Vendetta and Gym Pin to Rogue and Sorinex. It’s been awhile since my last patent but, if I remember correctly, you reference prior art to aid the patent examiner in their research of your product(s) and it’s respective claims. The examiner then determines if your new invention falls into the useful, novel and non-obvious category. One interesting statement I found was this, “However, a product that enhances or expands upon a previous invention may be patentable. However, even if the differences would make them very unique to one another, the patent application may be rejected if the differences would be obvious.” I’m guessing this could have been the case with this situation. I look forward to hearing what PRX has to say.

Quite paradox. The whole patent idea is invented to protect small business subject to not be overcome by big players with resources advantage like marketing and manufacturing options. But at the end under these circumstances the patent process works in opposite manner..

PRx should reach out with a settlement offer. It isn't a good thing for PRx or its reputation to let this patent controversy fester.

your products an add on. its good I get it. But theirs is a complete product. I know its close to your product and vendetta's but Chopping their hands off for it means the consumers end up with a worse product and the consumers suffer. So for you I understand the upset. I guess what I'm saying is I'm not behind the whole patent system. It could be better so that inventors can collaborate. and the product evolved with competition and it honestly means everyone gets a better product. I mean one solution is that patents last a maximum of 3 years or something?

Love the idea at the end! I too have so many ideas that i would like to make, but i do not necessarily have the resources to make these or knowledge regarding the whole process including patents.

PRX looking to not get sue. You can not patent something that was in the market before you started your own version of it. Patents dont work like that. I went through 4 years of court against a counterfeiter to know a little of how this works. We went through deposition and everything.
